ASSIGNED PROPERTY ESTATE
ESTATE VALUE LESS THAN $25,000

If property owned solely by the deceased has a net value of $25,000 or less, the Court may issue an Order that a decedent’s property be turned over to persons in the following priority:

1. The surviving spouse, if any, OR
2. Upon the showing of evidence that the funeral expenses were paid, to the person who paid the funeral expenses, to the extent of the payment, and the balance to the spouse; if there is no spouse, to the decedent’s heirs.
(Total value of decedent’s property remaining after payment of funeral and burial expenses must not exceed $25,000.)

____Petition and Order for Assignment (PC-556) must be filled out completely on both sides, including signature and date.
____If necessary, Consent (PC-561) must be signed by heirs to allow the Assignment.
____The total value of estate after funeral and burial expenses does not exceed $25,000.
____A copy of death certificate is attached.
____Statement of funeral expenses is attached; paid or unpaid.
____Check for filing fees is attached.

NOTE: Except for the share of the surviving spouse or any minor child, the share of each heir, for 60 days from the date of the Order, shall be subject to any unsatisfied debt of the decedent up to the value of the property received through the Court Order.
